Setting up and self-managing your own super fund means that you want to have an active influence on your superannuation. You want control and are proactive in maintaining your investments. Once a super fund is set up there are many things that may affect the advice that we give you or the instructions that you give us over the course of its life. Indeed, there are many changes to your retirement that we can help you with, in conjunction with our financial planning arm.


Legal Engagement

​We will prepare the superannuation fund's accounts for the purposes of the Superannuation Industry Supervision Act 1993 (the SIS Act). However, this service does not cover any inquiries or investigations by the ATO. We also prepare and lodge the SMSF annual return, year-end financial statements, including member benefit statements, and Activity Statements if applicable.  It is important to note as part of the regulatory framework for SMSFs, an annual audit of the fund must be undertaken and provided to the trustees of the fund before the SMSF annual return is lodged. In addition to the basic financial information required to complete these requirements, it is expected that the source documentation will be available to allow this firm to analyse the implications of any superannuation related transaction.


With respect to the annual audit of the SMSF referred to above, this office will make arrangements for the audit to be undertaken by an external party, whereby you will be billed directly and liable for the associated costs. You should also note that the deeds of the fund should be annually reviewed by a superannuation specialist to ensure they continue to comply with the requirements of the SIS Act.  Our engagement does not extend to the provision of such legal advice and our fee does not include this service. Our fee also does not include financial planning services for the investments of the superannuation fund or for any planning advice for your future retirement planning needs.

    ​We will provide assistance with the establishment of your SMSF and incorporation of the corporate trustee if applicable. *

    ​Sometimes your circumstances change or the law changes and we need to upgrade your SMSF deeds to reflect current legislation.

    ​Often people wish to use their own resources external of the superannuation system to help purchase an asset and mostly this means the use of a trust. We discuss the entities and the logistics of the structure with you.

    ​Bare Trusts
    ​If you want to borrow inside a super fund, then you will need a bare trust, also known as a limited recourse loan. We will help you set up this arrangement including liaising with banks and lawyers.

    ​A great way to save tax is to have the SMSF in pension phase. By law, this means you will need an actuarial certificate which we source and provide to you. We will provide assistance with establishing pensions, making lump sum withdrawals, preparation of paperwork and calculations in relation to the commencement and maintenance of pensions. *

    ​If your SMSF contains property, you need to report the current market value to the ATO. We help you facilitate the requirements to obtain this figure.

    ​SMSF’s need a clear paper trail of decisions. We will help you prepare the documentation to add to the secretarial file of the fund.
